Card-not-present fraud is a type of credit card scam in which the customer does not physically present the card to the merchant during the fraudulent transaction. Card-not-present fraud can occur with transactions that are conducted online or over the phone. It is theoretically harder to prevent than card-present fraud because the merchant cannot personally examine the credit card for signs of possible fraud, such as a missing hologram or altered account number.
What to Do If Credit Card Theft Happens to You
In the event that your credit card is stolen in the United States, federal law limits the liability of cardholders to $50, regardless of the amount charged on the card by the unauthorized user. In today's world of electronic fraud, if just the credit card account number itself is stolen and the theft is reported before any charges are made, federal law guarantees that the cardholder has a zero liability to the issuer. Numerous credit card companies have also adopted a zero liability policy, which means the consumer is not held responsible for any fraudulent charges at all. The terms and conditions of your cardholder agreement often spell out the details.
As a cardholder, you should notify the issuer immediately if you notice that your credit card is missing or stolen. This early notification will give the issuer time to help you with the following:
Verify if and where fraud has occurred.
Remove unauthorized charges from your credit card account.
Close down your account to prevent future fraudulent charges.
Issue you a new card and account number.
You should also check with the three major credit reporting agencies and obtain a copy of your credit report to be sure that nothing else has been accessed fraudulently.
According to the Fair Credit Billing Act, consumers have 60 days from the time they receive their credit card bill to dispute a charge with a card issuer. Charges must be over $50 to be eligible for dispute. They may be unauthorized, display an incorrect date or amount, or contain calculation errors. If a good or service was not delivered, that charge can be disputed.
The card issuer then has 30 days to acknowledge receipt of a complaint, and have two billing cycles to complete their investigation; during that time the issuer is not allowed to try to collect the payment, charge interest on it, or report it to credit bureaus as late. These limitations only applied to the disputed payment, not other charges made during the same billing cycle, which can still accrue interest and be reported as late if not paid.
Be Wary of Credit Card Protection Offers
This type of insurance is unnecessary because of the federal limits in place. Often times, your bank or credit card company will have identity protection or fraud protection services already in place just by being a customer. Third-party companies that offer credit and identity theft insurance can be expensive and often simply follow the same steps that you would in reporting unauthorized spending on your card.
But beware: some scam artists try to sell $200-300 credit card insurance by falsely claiming that cardholders face significant financial risk if their cards are misused.
Vigorously Monitor Your Reports
A great way to monitor activity on your accounts is to order your credit reports for each credit card reporting company. In fact, federal law states you are allowed one free credit report per year, but if your card has ever been stolen, you may be able to get your reports for free more frequently. Some experts recommend ordering one report every four months, in essence staggering requests via each of the main companies. This is a great way to keep a lookout for fraud. A weekly or monthly check-in of credit activity via your card's main website can also provide insight into any potential fraudulent activity.

Remember, if someone steals your card and rings up hundreds of dollars in charges, you are not on the hook, although it can take time to sort out the charges and get reimbursed. Exact details may vary between credit card issuers, but they all provide a similar service. When you’re ready to shop, you can request a virtual credit card number online. You may be able to set a custom spending limit and an expiration date.
You will then be issued a temporary 16-digit credit card number that you can use to shop online. Depending on the provider, your charges may show up on your monthly credit card statement along with purchases made with your physical card.
If at any point a thief gets ahold of your virtual card number, they won’t be able to exceed the preset spending limit or make purchases beyond the predetermined expiration date. Some virtual card numbers work only with specific predetermined merchants, further protecting you from theft. Plus, your physical card number is still protected.

The advantages of virtual card numbers
The Fair Credit Billing Act dictates that you’ll never be liable for more than $50 in unauthorized charges if your credit card is lost or stolen. That amount drops to $0 if you report your card as stolen before it is used or if your number, not your card, is stolen. Major card issuers such as Visa, Mastercard, Discover, and American Express also provide zero liability for unauthorized charges, meaning the $50 liability does not apply.
However, if your credit card information is stolen, you may still need to spend time disputing charges, filing a police report, and replacing your card. After that, you’ll have to update any accounts that have your compromised card on file. Using a virtual credit card number at any online merchant can save you some major headaches if that merchant is ever hacked or compromised.
The benefits are even clearer when you examine the laws surrounding ATM and debit cards, which are determined by the Electronic Fund Transfer Act. Your liability varies based on when you report the loss of your card. In fact, you could be responsible for all the money taken from your card account if you fail to report it in a timely manner. If you regularly use your debit card for online shopping, switching to a credit card that offers a virtual card number service may provide additional peace of mind.
Limitations of virtual card numbers
Virtual card numbers aren’t absolutely necessary, as you can’t be held responsible for more than $50 in unauthorized charges on your credit card, and you won’t be held liable at all if your number is stolen online or if your card issuer offers zero liability for unauthorized purchases.
If you are interested in using virtual card numbers, keep in mind that not all credit card issuers offer the service. Third-party virtual service providers exist, but their quality of service may vary and they require you to sign up for an additional account.
Plus, switching to virtual card numbers won’t completely protect you from fraud or theft. You still need to monitor your statements for unauthorized activity. Your physical card could still be stolen, and any accounts that use your physical card number could be compromised.

Starting in 2013, merchants in Michigan free credit card numbers with money already on them 2017 charge customers extra if they use a credit card. Called surcharges, retailers may—but are not required to—charge for processing a credit card transaction. How much a merchant may charge depends on the terms of the merchant’s agreement with its credit card processor.
The typical cost of processing credit card transactions is between 1.5 and 3%. And most MasterCard and Visa agreements limit surcharges to the actual costs of processing the credit card transaction or 4%, whichever is less. But your merchant may charge more or less, depending on the specific terms of its credit card merchant contract.

Spot it: Surcharge Required Disclosures
Brick and mortar sellers who choose to impose a surcharge must post a notice at the store’s entrance and at the point of sale advising that a surcharge applies to purchases made with identified credit cards.
Sales receipts must itemize the exact amount of the surcharge.
Online sellers have to disclose that a surcharge will be imposed on the website page where credit cards are first mentioned.
Stop it: Report Violations
You can report complaints or violations to the applicable credit card carrier online—Visa; Mastercard.
Special Rules for Surcharges at Gas Stations
Beginning July 2017, Michigan law requires gas stations whose advertised motor fuel price is subject to one or more conditions (such as cash payment or a carwash purchase) to post those conditions on road signs next to the advertised fuel price, with equal illumination, in lettering of the same style and of at least ½ the size used to post the sale price.
