SAN FRANCISCO -- Complaints of the Employment Development Department's website going down over the weekend renewed concerns about the department's management of the pandemic-caused unemployment crisis.

Our ABC stations across California have received multiple reports from viewers that the EDD's website was either down or glitching, preventing them from logging in to certify for their edd state of california contact number -- creating more worry that payments would be further delayed.

"Beginning on Sunday, some claimants looking to certify for their next two-week period of benefits encountered intermittent issues with the system. We still had more than a half million people come through to certify and certifications continue coming through today. The UI Online and SDI Online pages are otherwise working fine. We apologize for the inconvenience.

"If claimants encounter an issue while certifying for benefits, we recommend they check back a little later. EDD's Information Technology team continues to work on resolving the issue to mitigate impacts. "My office is very shortly going to be formally and officially asking for a three-month report on the outages," Assm. Patterson said of the reported website outages. "And we want that to be available to me and available to the public. We're going to find out precisely how often, how long and what's wrong. Or they're going to basically, I think, have to face me and other members of the California legislature."

In a bit of good news, Deborah Scott updated 7 On Your Side and said she was able to get into her account to certify -- she thinks. "It took, but to confirm that it took, it wouldn't allow me. It wouldn't let me see in an inbox. It wouldn't let me go back into the web page. So I didn't truly know if I actually certified," she said. Not long after that, Scott was able to confirm she successfully certified for benefits.

IF YOU FILED FOR TRADITIONAL UNEMPLOYMENT INSURANCE (UI), NOT PUA, AND YOUR 2020-2021 BENEFIT YEAR HAS EXPIRED, YOU MUST FILE A NEW CLAIM TO CONTINUE RECEIVING BENEFITS. IF YOU RECEIVED AN EXTENSION, BUT YOUR BENEFIT YEAR HAS EXPIRED, YOU MUST FILE A NEW CLAIM.

Filing online is the quickest way to re-apply. EDD has told us that if your online application goes smoothly, you should be set within 2-3 weeks of re-applying.

If you are unable to file online, the next quickest way to call EDD. Our staff do not have access to the EDD system nor are we able process claims, but you may be able to reach an EDD rep who does when you call.  Here are tips on how to call EDD:

  • EDD phone numbers 1-833-978-2511 or 1-800-300-5616 – both numbers go to the same center
  • Monday – Sunday between 8 am and 8 pm PST (10:15/10:30 am or closer to 6, 7 pm seem to be best). 
  • Press 1 during the 1st recording, then press 2, then press 4 to get through to an EDD rep
  • Persistence is key when calling EDD.  You may get a message that your call cannot be completed at this time.  Hang up and try again. It may take some time and dialing to get connected to someone who is able to help you
  • Some EDD reps cannot transfer you, so you may need to call back to ask for a rep who can do this
  • There are 4 levels of EDD reps:
    • Tier 1 – cannot help you change problems and have limited access to your account.  Will usually offer to put you on a ‘call back’ list.
    • Tier 2 – have access to your account and can make some changes but you should ask for an adjuster if you have a complicated claim problem
    • Adjusters – have access to your account and can resolve complicated claim problems and if they cannot assist are able to email a supervisor or let you know what is going on with your account or what you should/can do to resolve
    • Supervisors – have full access to your account and can resolve complicated claim issues but usually work behind the scenes on issues that Adjusters can’t resolve
  • Please note that it is taking at least 3 weeks to process and pay when you file a new claim if your benefit year has expired and EDD staff cannot help accelerate this process.  But if it has been over 3 weeks since you applied, and you are asking when your claim will be paid and/or your claim payments on that new claim are still pending a week or two after certifying, you can ask if the EDD rep answering the call is a Tier 2 rep and that person should be able to help.
  • And if you have a complicated claim issue, and have multiple weeks pending or another issue, it is best to ask for an Adjuster when you call.

IF YOU HAVE FILED A NEW CLAIM BUT ARE MISSING PAYMENTS:

You can check the date your claim was initially filed on your UI Online homepage under Benefit Year on the right side of your Claim Summary. Your issue might be that there is a gap between when your old benefit year ended and when your new year begins.

Once you file your claim, you need to backdate your start date to the day after your benefit year ended. This is the only way to ensure you receive the missed payments between when your benefit year ended and when you started your new claim. For example, if my benefit year ended on 3/22/21 and I filed a new claim on 4/1/21, I would request to backdate my claim to 3/23/21.

To backdate your claim, go to https://askedd.edd.ca.gov/, click on the Category “Unemployment Insurance Benefits,” then click on the Subcategory “Claim Questions,” then select the Topic “Backdate the Effective Date of my Claim Due to COVID-19” and click “Continue” to fill out claim information and type “Backdate my claim to mm/dd/yyyy” in the space provided for the new claim to start immediately after the previous claim’s ending date.

LOS ANGELES – A former California Employment Development Department (EDD) employee has agreed to plead guilty to a federal criminal charge for causing nearly 200 fraudulent COVID-related unemployment relief claims to be filed in other people’s names, resulting in more than $1.6 million in ill-gotten gains, the Justice Department announced today.

          Gabriela Llerenas, a.k.a. “Maria G. Sandoval,” 49, of Perris, signed a plea agreement that was filed today in which she has agreed to plead guilty to a single-count information charging her with mail fraud.

          Court records show that Llerenas previously worked at EDD as a disability insurance program representative. She resigned in March 2002 after admitting to fraudulently authorizing and paying disability benefits administered by EDD. She was sentenced to 37 months in federal prison in connection with that scheme.

          The new scheme that Llerenas has admitted running took advantage of the expanded eligibility for unemployment insurance (UI) benefits made possible by the Coronavirus Aid, Relief, and Economic Security (CARES) Act passed by Congress and signed into law in March 2020. The CARES Act provided additional UI benefits to qualified individuals and helped provide UI benefits during the COVID-19 pandemic to people who did not otherwise qualify, including business owners, self-employed workers, independent contractors, and those with a limited work history.

          From April to October 2020, Llerenas filed and caused the filing with EDD of fraudulent unemployment insurance benefits that falsely asserted the named claimants were self-employed independent contractors – often identifying them as cake decorators or event attendants – who were negatively affected by the COVID-19 pandemic. Llerenas obtained some of the names, Social Security numbers and other identifying information she used to submit the fraudulent claims through her prior work as a tax preparer.

          In her plea agreement, Llerenas also admitted to falsely stating on some of the applications that the claimants were residents of California entitled to unemployment insurance benefits administered by EDD when in fact they lived elsewhere. She also admitted that, on some applications, she inflated the amounts of income she reported for the claimant to maximize the benefit amount. She also admitted to sometimes filing a dozen or more fraudulent EDD claims in a day.

          As a result of the fraudulent unemployment benefits applications that Llerenas filed and caused to be filed, EDD authorized Bank of America to mail debit cards in the names of the claimants to addresses she provided, including her residence, her husband’s business location, her mother’s apartment and the addresses of friends and other family members.

          Llerenas admitted that she charged the named claimants a fee for filling the applications, best food to get in nyc was often paid out of the fraudulently obtained benefits. In at least one case, she told the named claimant that she was still employed at EDD and could control the distribution of the unemployment insurance benefits, and then demanded an additional payment for “releasing” the benefits.

          In total, 197 debit cards were fraudulently issued because of this scheme, resulting in losses to EDD and the United States Treasury that Llerenas has admitted were at least $1,633,487.

          Llerenas is scheduled to make her initial appearance on September 22. The criminal offense to which Llerenas has agreed to plead guilty carries a statutory edd state of california contact number sentence of 20 years in federal prison.

Constituent Service Request - Employment Development Department

Since March 2020, my office has been flooded with calls and emails asking for help with contacting the Employment Development Department (EDD).  While we have resolved over 4,000 cases to date, we continue to take on new cases relating to EDD every day. 

We also ask that you 1) read all messages sent to you from EDD through UI Online; 2) [email protected]_EDD on Twitter; and 3) try to regularly readEDD's News Releases.  It is inexcusable that more than a year and a half has passed since the start of the pandemic and it remains nearly impossible to contact EDD directly to have your questions answered.  My office remains committed to helping you get the answers you need and are doing our best to make sure your claim is processed and considered fairly by EDD. We do ask though, before you complete this form, you first look at the EDD's Frequently Asked Questions page and most recentnews releases.

If you received benefits through a PUA claim because you were self-employed before the pandemic, the federal Continued Assistance Act requires PUA claimants who received benefits after December 27, 2020 to submit documentation to prove they were (or planned to be) self-employed or employed when they applied for benefits.

Starting November 10, 2021, EDD will send notices by email, text message, and through UI Online to those who must submit their proof of work history to comply with federal rules.  Many claimants who filed for PUA have already proven their employment status, including those who collected PUA in 2020 and provided their 2019 wage and income information to obtain more than the minimum weekly benefit amount. If you are requesting to backdate your claim, Do Not Use This Form.  The only way to backdate your claim is by contacting EDD directly via one of the following options:

  • Visit Ask EDD to request to backdate your claim if you think it has the wrong start date. Select Unemployment Insurance Benefits, then Claims Questions, then Backdate the Effective Date of my UI Claim Due to COVID-19.
  • In your UI Online account, select Contact Us to request a change.
  • Call the UI Customer Service line at 1-800-300-5616, available from 8 a.m. to 8 p.m. (Pacific time), seven days a week, except state holidays.

Requests to assist in backdating claims entered into this form will not receive a response.  If you need our assistance with backdating a claim, you must send a letter requesting an exception via the United States Postal Service to: Office of Asm. Richard Bloom, 2800 28th St; Suite 105, Santa Monica, CA  90405.  The letter should include your SSN or EDD CAN, the effective date of your claim, your final day of work, the date you would like claim to be effective, and why you didn't contact EDD directly via one of the options above.  Your letter should also include copies of two Acceptable Documents for Identity Verification.  Due to the high number of fraudulent requests our office is receiving, backdating requests submitted via our Assistance Request Form will NOT receive a response.

Contacting EDD to Resolve Issues - My staff are not employees of EDD and therefore do not have access to your unemployment claim so it is important that you have done what you can do yourself to find answers to your questions.  As mentioned above, the best place to look for answers is the EDD website,EDD News Releases, and EDD's Twitter account @CA_EDD.  In some cases, calling EDD may be the only way to find an answer to your question so here are tips on how to call EDD:

  • EDD phone numbers 1-833-978-2511 or 1-800-300-5616 – both numbers go to the same center
  • Monday – Sunday between 8 am and 8 pm PST (10:15/10:30 am or closer to 6, 7 pm seem to be best). 
  • Press 1 during the 1st recording, then press 2, then press 4 to get through to an EDD rep
  • Persistence is key when calling EDD.  You may get a message that your call cannot be completed at this time.  Hang up and try again. It may take some time and dialing to get connected to someone who is able to help you
  • Some EDD reps cannot transfer you, so you may need to call back to ask for a rep who can do this
  • There are 4 levels of EDD reps:
    • Tier I – cannot help you change problems and have limited access to your account.  Will usually offer to put you on a "call back" list.
    • Tier II – have access to your account and can make some changes but you should ask for an adjuster if you have a complicated claim problem
    • Adjusters – have access to your account and can resolve complicated claim problems and if they cannot assist are able to email a supervisor or let you know what is going on with your account or what you should/can do to resolve
    • Supervisors – have full access to your account and can resolve complicated claim issues but usually work behind the scenes on issues that Adjusters can’t resolve
  • Please note that it is taking at least 3 weeks to process and pay when you file a new claim if your benefit year has expired and EDD staff cannot help accelerate this process.  But if it has been over 3 weeks since you applied, and you are asking when your claim will be paid and/or your claim payments on that new claim are still pending a week or two after certifying, you can ask if the EDD rep answering the call is a Tier 2 rep and that person should be able to help. 
  • And if you have a complicated claim issue, and have multiple weeks pending or another issue, it is best to ask for an Adjuster when you call.

Once we have EITHER your SSN or EDDCAN, we will process and send an inquiry to EDD on your behalf, you will receive a confirmation email from the staff member in my office assigned to your case who will serve as your point of contact until the matter is resolved.

Once you have completed our Request for Assistance Form, you will receive an email from our office within 10 business days asking you to complete an Authorization for Release of Information that you must complete, sign and return to our office.  If you have not received an email from us within 10 business days, please contact our office at (310) 450-0041 to provide us with your SSN or EDD CAN so that we can process your case. 

If you have already submitted a request but have not heard from us, it is likely because you have not provided either your Social Security Number or your EDD Customer Account Number (EDD CAN). 

IMPORTANT:  If you disagree with EDD on a determination made about your application, your eligibility, your claim start date, your benefit award, etc, you have the right to appeal the determination. While waiting for us to process and submit your case to EDD, DO NOT DELAY Your Decision to Appeal.  You only have a short window of time to file an appeal, so it is important you submit as soon as possible.

IF YOU FILED FOR TRADITIONAL UNEMPLOYMENT INSURANCE (UI), NOT PUA, AND YOUR 2020-2021 BENEFIT YEAR HAS EXPIRED, YOU MUST FILE A NEW CLAIM TO CONTINUE RECEIVING BENEFITS. IF YOU RECEIVED AN EXTENSION, BUT YOUR BENEFIT YEAR HAS EXPIRED, YOU MUST FILE A NEW CLAIM.

Filing online is the quickest way to re-apply. EDD has told us that if your online application goes smoothly, you should be set within 2-3 weeks of re-applying.

IF YOU HAVE FILED A NEW CLAIM BUT ARE MISSING PAYMENTS:

You can check the date your claim was initially filed on your UI Online homepage under Benefit Year on the right side of your Claim Summary. Your issue might be that there is a gap between when your old benefit year ended and when your new year begins.

Once you file your claim, you need to backdate your start date to the day after your benefit year ended. This is the only way to ensure you receive the missed payments between when your benefit year ended and when you started your new claim. For example, if my benefit year ended on 3/22/21 and I filed a new claim on 4/1/21, I would request to backdate my claim to 3/23/21.

To backdate your claim, go to https://askedd.edd.ca.gov/, click on the Category “Unemployment Insurance Benefits,” then click on the Subcategory “Claim Questions,” then select the Topic “Backdate the Effective Date of my Claim Due to COVID-19” and click “Continue” to fill out claim information and type “Backdate my claim to mm/dd/yyyy” in the space provided for the new claim to start immediately after the previous claim’s ending date.

EDD website down: California residents unable to access unemployment site

SAN FRANCISCO -- Complaints of the Employment Development Department's website going down over the weekend renewed concerns about the department's management of the pandemic-caused unemployment crisis.

Our ABC stations across California have received multiple reports from viewers that the EDD's website was either down or glitching, preventing them from logging in to certify for their benefits -- creating more worry that payments would be further delayed.

Deborah Scott of Napa told 7 On Your Side: "You feel sick to your stomach, thinking that what if this is it? What if I'm going to fall into that Bermuda Triangle hole where there will be no money until the summer?"

When asked for comment, the EDD Media Services team initially responded saying, "We're working to get system status details from our IT branch and will send an update as soon as we have more information."

Late on Monday, the EDD offered a more detailed explanation:

"Beginning on Sunday, some claimants looking to certify for their next two-week period of benefits encountered intermittent issues with the system. We still had more than a half million people come through to certify and certifications continue coming through today. The UI Online and SDI Online pages are otherwise working fine. We apologize for the inconvenience.

"If claimants encounter an issue while certifying for benefits, we recommend they check back a little later. EDD's Information Technology team continues to work on resolving the issue to mitigate impacts. When the issue is resolved, we'll update the text on the SDI and UI Online pages: https://portal.edd.ca.gov/WebApp/Login?resource_url=https%3A%2F%2Fportal.edd.ca.gov%2FWebApp%2FHome."

In response to his constituents' complaints about the EDD website, California Assemblyman Jim Patterson (R - Fresno), held a Zoom conference in which he criticized the EDD's handling of the situation and called for more accountability. He said his office received reports that the EDD website went down over the previous Saturday and Sunday.

"Here's what we know as of now," said Assm. Patterson. "The EDD system has been down; it's been off and on for several days now. We are also receiving from our inside sources at EDD, they have confirmed that it's down. As of five minutes ago, EDD did report to us that it was down that they are working on it."

Assm. Patterson voiced his constituents' frustration: "On top of that, people cannot reach someone on the phone. The EDD call center is almost worthless. And now people cannot access the website, there is nowhere else for people to turn now."

"My office is very shortly going to be formally and officially asking for a three-month report on the outages," Assm. Patterson said of the reported website outages. "And we want that to be available to me and available to the public... We're going to find out precisely how often, how long and what's wrong. Or they're going to basically, I think, have to face me and other members of the California legislature."

In a bit of good news, Deborah Scott updated 7 On Your Side and said she was able to get into her account to certify -- she thinks. "It took, but to confirm that it took, it wouldn't allow me. It wouldn't let me see in an inbox. It wouldn't let me go back into the web page. So I didn't truly know if I actually certified," she said. Not long after that, Scott was able to confirm she successfully certified for benefits.

California Gov. Gavin Newsom's administration on Thursday announced a major change in how the state pays unemployment benefits, potentially unlocking payments for up to 100,000 people who have gone weeks or months without assistance.

Getting unemployment benefits is a two-step process. First, state officials must decide if people are eligible. If they are, the state starts paying them. But those people must contact the state every two weeks to confirm they are still eligible to keep getting paid.

Sometimes, state officials must investigate residents' eligibility after they have been paid. When this happens, the state stops paying them until the investigation is complete. Before the pandemic, these investigations usually did not take long. But during the pandemic, the state has been overwhelmed with millions of claims that have caused lengthy delays.

The Employment Development Department announced Thursday it would keep paying people unemployment benefits even while they are investigating their eligibility. The change is part of a lawsuit settlement between the state and the Center for Workers' Rights, an advocacy group.

The change applies only to people who have certified for benefits and have already received at least one week of payment in the past. Daniela Urban, the group's executive director, said it could impact up to 100,000 people.

"This is a monumental change by EDD that will allow more claimants to be paid on time," she said.

Unemployment claims skyrocketed across the country during the pandemic, causing backlogs in many states.

Claims have slowed since then, but California still has more than 3 million people receiving some form of unemployment benefits. The state has had a persistent backlog throughout the pandemic.

The change is not without risk for Newsom, who is facing a recall election in September. The governor has been heavily criticized for failing to stop billions of dollars in fraudulent benefit payments to prison inmates  and others who were not eligible to receive them. But he's also faced complaints for a growing backlog of people with legitimate claims who have been unable to get paid because of a complex bureaucracy overwhelmed by the pandemic.

"There's a continuing trade-off between rapid payment of unemployment insurance claims and anti-fraud protocols," said Michael Bernick, a former Employment Development Department director who is now an attorney for the Duane Morris law firm. "This action today in paying continuing claims that have had previous verifications seems to have low fraud risks, while reducing the backlogs."

It's possible this action will cause the state to pay people who are not eligible. In a news release, the Employment Development Department said people who get benefits when they are not eligible could have to pay those back at some point. But it is possible to waive repayment if people claim financial hardship and the overpayment was not the result of fraud.

State Assemblyman Jim Patterson, a Republican from Fresno, said the state's action is a "stunning admission that they can't do their fundamental task" of paying legitimate claims while rooting out fraud.

"Now to clear their giant backlog, they're going to take the dangerous risk of paying fraudsters, too," Patterson said. 

Since March 2020, more than 23 million people have filed unemployment claims in California, and the state has paid $160 billion in benefits. Meanwhile, more than 226,000 people are still waiting for the state to resolve their claims and pay them.

They include 57-year-old Abdulkarim Adam, who lost his job as a bus driver for a private company during the pandemic. The state stopped paying him unemployment benefits in March and never told him why, he said. 

Adam had to borrow money from friends and move in with his sons while he waited. He said he called the state every day but could not get through. He was surprised to later receive a text message from the agency, asking for feedback on their customer service. 

Adam said he replied with a flattering message, hoping that would spur the agency to pay him faster. When that didn't work, he later sent an angry message comparing the agency to the authoritarian dictatorship in North Korea. 

He was relieved on Thursday to finally hear about the state's policy change and hoped it would get him his money faster.

"It will ease a lot of financial difficulties, and it will improve our lives," he said.

The Employment Development Department received more than 5.8 million calls from 421,005 unique callers in the final two weeks of June, according to a report posted on the department's website. The department said it answered 478,749 calls during that period.

Urban said many of those calls were from people like Adam wondering why their benefits were halted. She said fewer of those people will likely call now that they know their benefits won't be interrupted.

"I think it will allow claimants to be more confident in relying on the support of these unemployment benefits, while they still have them, as they look for post-pandemic work," she said.
